Resignation and termination

UAE final settlement after termination

Employer-initiated termination can involve ordinary notice, payment in lieu, a no-notice allegation or a separate dispute about the reason for dismissal. Keep the settlement calculation separate from the dispute analysis.

Identify the termination route

Check whether notice is being worked, paid in lieu or alleged not to be required. The termination letter should state the effective date and the employer's position.

Calculate the ordinary settlement first

Salary due, unused leave and gratuity or scheme benefits should be calculated under the applicable framework. Do not assume a dispute about dismissal automatically changes every line.

Keep additional compensation separate

A claim relating to unlawful or arbitrary termination is not the same as ordinary final settlement. It may require evidence and an official decision rather than a calculator.

Check unemployment-insurance timing

Employees who lost work involuntarily may need to review ILOE eligibility and claim timing separately. Resignation and disciplinary termination can affect eligibility.

Questions to ask HR or payroll

  1. What article or contract clause is the employer relying on?
  2. Is notice worked or paid?
  3. What date does employment legally end?
  4. Are ordinary entitlements being withheld because of a separate dispute?
  5. Do I need to submit an ILOE claim within its deadline?

Frequently asked questions

Does termination remove gratuity?

Not automatically. The applicable law, reason, service and any specific exclusion must be examined.

Is notice pay part of gratuity?

No. They are separate components using different calculation logic.

Can a calculator estimate arbitrary-dismissal compensation?

It should not present such compensation as automatic. A disputed claim depends on facts and official or legal assessment.
