Claims and evidence

Final settlement when a UAE employer closes or cannot pay

A business closure can create both an employment claim and a practical recovery problem. Act quickly to preserve records and identify the responsible authority.

Record the employment end and unpaid amounts

Prepare the same line-by-line settlement schedule used in an ordinary exit. Do not rely on a verbal promise that all employees will be paid later.

Preserve employer details

Keep the legal company name, licence details, work permit, office address and known closure notices. Brand names alone may not identify the employing entity.

Check worker-protection arrangements

MOHRE describes worker-protection and insurance programmes that can cover certain unpaid entitlements, subject to scheme conditions and official handling.

Use the appropriate complaint and insolvency route

Submit employment claims through the correct authority and obtain professional advice where insolvency, liquidation or court proceedings affect recovery.

Questions to ask HR or payroll

  1. What is the employer's legal entity name?
  2. Has a formal closure or liquidation been announced?
  3. Which wages and entitlements are unpaid?
  4. Is worker-protection insurance applicable?
  5. Which authority or court is handling the company?

Frequently asked questions

Does company closure cancel gratuity?

No. The entitlement calculation and the ability to recover payment are separate questions.

Will insurance always pay the full settlement?

No. Coverage, caps and eligibility depend on the applicable programme and official decision.

Should I wait for the company to reopen?

Preserve documents and seek official guidance promptly rather than relying only on informal assurances.
